Dickson County, Tennessee's, Judge Durwood Moore routinely pulls random spectators out of his courtroom, has them taken into custody, and has these citizens undergo urinalysis according to a report at courthousenews.com. Judge Durwood Moore is a moron.
A federal lawsuit filed by Benjamin Marchant sets forth allegations that are too strange to be true, but are true. The Tennessee judicial disciplinary authorities have issued an order restraining Judge Moore. No kidding. Here's the question, why is this guy still a Judge? I mean this isn't even arguable; when you become a Judge you take an oath to uphold the constitution.
Bad Lawyer was being rushed out the door, to a "youth-event" when this item was originally posted. While typos, and grammatical infelicities are my stock in trade, my haste in posting left me wondering whether I'm smarter than a fifth grader--you notice, I didn't say more ethical.

ReplyDeleteUnfortunately it is clearly arguable, unless we want to disregard the existence of the privileged class that tends to make up most of the positions of power within the United States. These are the people that are given the benefit of the doubt and the presumption of innocence. They receive slaps on the wrists while the the average person is spending his days in prison. They receive tarp funds after holding a nation's economy hostage.
If it were as simple as breach of oath or law, then we wouldn't see such arrogance and abuse. Sadly, this all to common spectacle of a two-tiered justice system only reinforces those in power to disregard the needs of the many and to become ever more audacious in their delusion of self-importance.

ReplyDeleteI live in Dickson County. I sometimes write guest columns in our local newspaper "The Dickson Herald". I wrote a column regarding (in part) Judge Moore and his insanity. It appeared on Feb.3,2010 He's known as "the hanging judge" here in Dickson. It is rumored that he is an ex Hell's Angel, but I can't substantiate this. I'm told by old timers here that he has been in office for about 40 years. This judge hands out 10 day sentences like it was Halloween candy. I have several friends who were victims of his "Judge Roy Bean" mentality. I'm astonished that he was merely censured rather than kicked-off the bench. This antiquated egomaniac is not fit to judge a pie eating contest, let alone make life-altering decisions to people day after day. I sincerely hope that EVERY one of his former victims will come out of the woodwork and sue. We have another judge here that was censured too. Our County Juvenile Judge Andrew Jackson was taken to task a couple years ago for racial profiling kids whose parents he thought were illegal immigrants. He'd put them into DCS custody in a heartbeat when neglect was not even an issue. He's arrogant, rude, condescending, and pompous. His family practically owns Dickson, and his cousin is a State Senator. He likes to intimidate people in his court too. He has his bailiff bring out a huge pistol and lay it on his desk within hand's reach right before he ascends his throne. Jesus, Joseph, Mary, and Henry.... isn't it time we kicked these assholes out of office??
ReplyDeleteWhen I was a teen, after running away from an abusive home I found myself in custody of judge Jacksons residential "treatment center" mistreatment would be a more appropriate name. But the whole thing was a scam to charge insurance and medicaid to basically lock up children. Judge Jackson is as crooked as they get and as soon as these kids would meet the criteria to leave the program ...he would charge them with some sort of other charge to make sure they stayed. I was there over a year after being deemed incorrigible and sentenced to 60 days initially. At least I got away from my family... but that wasnt how I planned on doing it
DeleteThanks for sharing your special insight about the problem with this Judge. These sorts of characters abound in venues throughout our great country. When we elect these "tough" judges and prosecutors we forget about the rule of law, we turn our collective back on our constitution, and our highest ideals. Damn shame.
ReplyDeleteDoes anyone know what is involved in getting an appointed magistrate ousted? We have a loose cannon here in Dickson who denies about 50% of domestic abuse arrests. His reasoning (or lack thereof) defies belief! If you don't believe me, google the name Magistrate Milton Genella, Dickson, TN and you'll find where Channel 4 News I-Team investigated him. Watch the two videos. Anyway, I cannot find out how to get rid of magistrates. They answer to no one it seems. has anyone heard about getting rid of one by starting a petition?
ReplyDeleteI have personally witnessed Durwood Moore's atrocities in the courtroom. My sister-in-law (who has been deaf since birth and frequently makes noises without knowing it) and my wife (who was 8 months pregnant at the time) were taken into custody for contempt because my wife's sister made a noise in the courtroom. Luckily, they were never taken to jail and were released after 2 hours in handcuffs. This asshole needs to be booted out of office. There is no telling how many innocent people are in the Dickson County jail right now just because this guy is a total douchebag. This county is so corrupt it's not even funny. Andy Jackson is another fine example of what a cesspool the local judicial system is. My mom used to work for this particular dickhead at Jackson Acadamy, (a facility that houses juvenile boys in trouble with the law). Not only does he abuse his power on the bench, he is an alcoholic and a sexist who made many unwelcome advances towards my mom in the short period she worked for him. He sat on the bench and sentenced boys to this facility (that he owned). I wonder how much money he made from the state by sending these boys to his own facility? We need to get these assholes out of office as soon as possible.
ReplyDeleteNo one is aware Andrew Jackson was involved back years ago his personal plane was tracked by DEA being found full of cocaine. And he suffered no consequences and is still a judge handing down the hardest of consequences and taking children away from their parents over misdemeanor marijuana charges! Our judicial system is a f***king joke!!!

ReplyDeleteI just stood before him fighting a bogus ticket that a state trooper wrote me. They wouldn't allow me to really argue my point and wouldn't subpeona (spelling) the dashboard cam. The trooper lied under oath but Moore still found me guilty despite reasonable doubt.

ReplyDeleteBack in '98, I left my husband and tried to not be one of those parents that bad mouthed a father in front of our son. He did the bad mouthing. After 2 months of this, I tried to keep my son from his father, after repeated warnings. He took our son from daycare. I tried to talk to his father that night and it ended badly. He backhanded me and I fought back. I spent the next four days in jail for assault. While in jail, I had time to think over what happened and I remembered him pulling a phone number out of his pocket and, within 2 minutes, I saw and heard a car start up and flashing lights get turned on. That car was sitting there waiting. After I got out of jail, it took two months for the father to admit it had been a setup. The arresting officer and Durwood were involved. He had tried to hire Durwood but it was decided that I would need to go before him in court. A restraining order was put on me, my son was given to his father, I had court ordered visitation every other weekend and the father was still telling our son that I didn't love them anymore and it was my fault that our family was hurting. I was given a court appointed attorney. I told him that I fought back to defend myself. I was advised to plead guilty and I refused. The father finally decided to drop the charges, hoping I would return to him and he didn't want anything coming out in court. I was totally railroaded and my son has never gotten over all the things his father told him about me. He's 21 now and I hardly ever see him. The damage done can never be put right. Durwood was a dirty judge and I have no faith in our law enforcement or judicial system here. Too much of the good ole boy network going on for real justice to be served. I hope things work out for you. Sending prayers.
DeleteI hope this racist piece of $hit burns in hell...I lived in Dickson in 2005-2007 and had the misfortune of appearing before this racist moron...I'm from Ohio but moved to Dickson(for personal reasons).At the time I had been laid off by my employer & had a case pending in his court,he told me that I had to appear with an attorney on my next court date...I told him that I was unemployed & unable to afford a attorney,He looked at me & asked how I was able to bond out of jail(my father paid a out of state bondsman to bail me out),I asked what that had to do with me being able to afford a attorney with no means to retain one...after several court appearances(without showing up with any attorney...I dared him to find me in contempt)my case was transferred to Circuit Court where I was assigned a Public Defender(which I asked for in the first place)this is the most corrupt state in the nation!!!!
