Here's a disturbing story. Kentucky lawyer, D. Keith Johnson (pic) allegedly raped a local woman but was able to plead down to a misdemeanor. His sentence: 90 days house arrest with time off for the family va-kay....nice. Here's Jim Hannah's account for the Cincinnati Enquirer:
A Northern Kentucky lawyer charged with felony rape has pleaded guilty to a misdemeanor sex offense, angering the victim in the case. D. Keith Johnson, 45, of Fort Mitchell pleaded guilty Friday in Campbell Circuit Court to the misdemeanor charge of sexual misconduct. Kentucky law states that someone is guilty of this crime when they engage in sexual intercourse without the other person's consent.
Judge Fred Stine sentenced Johnson to 90 days of house arrest, but the Newport lawyer will be allowed to take a summer vacation during that time.
"Talk about a slap on the wrist," said the victim's lawyer, Tad Thomas of Louisville. "He gets 90 days in his own home ... and he is allowed to take vacation in the middle of it. My client is outrage at this sentence."
Johnson was also ordered to pay $655 in fines and court costs, complete 100 hours of community service, have no contact with the victim, take substance abuse and mental health evaluations and complete any recommended treatment.
If Johnson violates any of the conditions of his sentence during the next 12 months, Stine could order Johnson to serve one year in prison. There is nothing in Stine's order that requires Johnson to attend any sex offender treatment or register as a sex offender.
"It is incredibly disappointing that he gets this sentence," Thomas said.
Johnson's attorney, former Campbell County Commonwealth's Attorney Jack Porter, didn't return calls seeking comment. Porter previously said his client, who is married with children, admitted to having a romantic encounter on Jan. 1 in Campbell County but that it was consensual.
Thomas said his client was agreeable to the reduced charge only if Johnson was sentenced to prison time. Thomas said his client would try to "seek justice" through a civil lawsuit.
Johnson's guilty plea and sentencing was moved to the Friday before the Fourth of July holiday weekend despite the fact that a court calendar posted on the Kentucky Court of Justice website listed Johnson's next hearing date for the Tuesday after the holiday [ . . . ]
Thomas said the special prosecutor assigned to the case, Fayette County Commonwealth's Attorney Ray Larson, notified his client that the hearing was last week but didn't inform her until after the fact that Johnson would get no jail time.
When asked whether he thought Johnson received favorable treatment because he has been a lawyer for more than 20 years in Northern Kentucky, Thomas said, "I don't know, but I'm very surprised at this sentence [ . ]"

Maybe, Johnson didn't rape this lady. Perhaps his plea deal was reluctantly entered into because of the significant legal peril how does this sentence make any sense. What's left out my excerpt was that there was apparently something real shady about the scheduling of the hearing in a way in which it appears that the victim and her advocates were prevented from participating. In short what happened, here, smells like special treatment.
We shall see what the Ky Bar does with his license, probably not much since he took a misdemeanor.

There is no doubt there was special treatment. Keith Johnson is a sick, sick man and the sentencing or lack thereof is disgusting. The victim is an upstanding, hardworking, highly moral person who was sexually assaulted by this predator. He took her panties for a trophy!
ReplyDeleteThe only reason Ray Larson even considered a plea was because the sentence included jail time. He didn't want the victim to suffer any more by going through a trial. The victim was willing to go through the trial to ensure Johnson received time behind bars so he couldn't hurt anyone else. The grand jury listened to her side of the story and Johnson's hour long testimony before indicting him. That alone speaks volumes for Johnson's version of the truth. He is a master of deceit and evidently Judge Stine is easily duped. Eric Deters even commented on his blog how Johnson would come to his office to pick Deters brain about a case while eluding to referring Deters the case. Johnson never referred the case, he just used the expertise of Deters to his own advantage. Tells you something about Keith Johnson.

DeleteSomething pretty fishy in this situation. It's hard to figure out how this is a just outcome, the vacation deal is a real howler.
ReplyDeleteFishy is a good term because this stinks to high heaven! Once again our justice system favors the wrong side. How on earth can a judge allow a plea deal of this kind? I guess with lawyers like Mr. Johnson that is why our Justice system is going to pot. To give a person a slap on the wrist for a rape charge is totally unbelieveable. And hey, that house arrest thing might be pretty rough, why don't you take the family out for a vacation in the middle of it. Outrageous! Hopefully the bar association will take the charges more seriously than Judge Stein did.
ReplyDeleteNo one posting was there but if this prosecutor reduced the charges, I guarantee there was a good reason why. My understanding is that the "victim" never said, "no." Didn't say "stop" and no force was used. How is that rape? She was posturing for a lawsuit against a lawyer.

ReplyDeleteDear July 11, 2011 "Anonymous"- This happened after a New Years Eve party. The victim had too much to drink and Johnson raped her, PERIOD! He is married with two children and she repeatedly told him throughout the night he is not her type. She thought he was a disjusting, fat pig and reminded him he was married. I can guarantee you she said "NO" because I know her well. She would never, no matter what the circumstances have a physical relationship with such a creep.

I know this man well and he isn't the monster everyone thinks. I think this woman is a money hungry bitch, trying to ruin a good lawyers life. Why didn't she say NO.

ReplyDeleteAlso she said he returned later that night and he broke in and was on top of her. what does she do leave her doors unlocked inviting some one in. why wasn't he charged for breaking and entering.This woman is not a victim she knew what she was doing, she is just wanting money and wants to ruin his life.
My prayers go out to the families involved. Keith is a wonderful person and a terrific father. There are only two people that know all the facts in this case and I want to caution people about their assumptions and comments here. My concern is not for the adults, but for the children. I know that there is frustration and anger in all the hearts of those who are very close to the families involved in this incident, but can we consider the children involved in this before we comment?
ReplyDeleteThe alleged victim (rightly so) is protected from scrutiny and this affords a level of privacy for her children not afforded to Keith and his family, so can we please pause before commenting?
I don't know Johnson or the alleged victim. Nevertheless, I have never witnessed the hierarchy fail to take the opportunity to protect itself. This case seems to affirm the assertion.

You think an occurance on New Years going throught the legal system (raising the complaint, filing charges, gathering evidence, the lengthy process of finding a venue not influenced by a local attorney, grand jury testomony, indictment process, setting bond, etc.) and hitting the papers in April is a lengthy delay on behalf of the complaintant/victim? Are you kidding me?
ReplyDeleteThe grand jury felt this case was strong enough to procede with an indictment. Gee, I wonder if they may actually know something about this case that may not be apparent in an Enquirer article.
I didn't see written anywhere that this woman stood to gain from dragging herself through this process. I can imagine that quite the opposite is true. Your apparent lack of understanding betrays your gender. So does your concept that anyone leaving a party deserves to be raped.
Code of conduct forbids me from commenting on what I think of your opinions so let me just say, You are either oblivious or working for the defendent.
BTW....She makes enough money herself, that she doesn't need his! It's just retribution for a slap on the wrist that he got in the back room of Judge Stein's office.
oh and....she didn't leave with just him. There was a group of people. He was the one that left his wife behind to stalk the victim!!

ReplyDeleteJohnson is known to drink too much. The lady definitely drank to much that night. Whatever happened has enough circumstances surrounding it that a conviction would be extremely difficult at best. In a case where she says one thing and the \male says another, I hope to god that the woman's word is not enough for a conviction to send a man to jail where forensic evidence doesn't substantiate the woman's claim..

If she was doing it for the money, who says this lawyer even has money? Do you really think someone would go through the whole mess of taking him to court if it was consensual? I am sure it is very expensive to have to get lawyers as well, I am sure no one has that kind of money laying around, and thinking, “hum, maybe if I sue someone for rape, especially a lawyer, maybe I can make some money”- come on, get real! What woman in their right mind would do this to themselves? One that is raped and needs to seek justice so this does not happen again. What if she did not go after him in court and he does it again, how do you think she would feel then? This man is disgusting, come on people, grow up and read ALL the facts of the case. This man sickens me...I know him because he represents an individual who I know personally who is also a very extremely sick person. These two are no doubt two peas in a pod...ugly! Together they lie, steal, and cheat the justice system! I am sure that Keith Johnson could not get a straight laced client to save his life. Only losers. He is an ugly, fat pig and this poor woman he raped will live with the thought of him raping her forever. I hope he gets what he deserves in this life and all of us dont have to wait until the after life to see this happen as one person blogged. He should definitely be disbarred and should also have whatever tiny little manhood he may possess be removed. Anything less is unfair to his victim. I have one more comment: what kind of person stays with a man like that? His wife must have no self esteem whatsoever and would be much better off getting herself and her children away from him and maintaining her dignity. How can she sleep next to a rapist at night? ReplyDeleteMy heart goes out to the victim in this trajedy and her family. I know what it feels like to be raped, and it is not something you want to re-live. I give her so much credit for going before the court to report the incedent in order to keep him off the streets. I'm sorry the system failed her.
I also agree with the blogger who wrote shame on the Judge in this case...I can only hope that the victim stays strong and does everything she can to make his life miserable. I hope she keeps that strengh!
I am just sorry he is not where he really belongs: in jail. Maybe there he can experience what happened to his victim!
I feel sorry for Keith Johnson's mother. That generation of parents took pride in their children and their accomplishments, she is either rolling over in her grave or wish she were dead. The man does not need help, he needs to be in jail for a long time. God help his children. How will they ever be able to face their friends who no doubt know their dad is a rapist. A leopord never changes his spots. He is who he has always been....SCUM!
ReplyDeleteThe Judge in this case should also be put in jail and experience what the poor girl..the victim had to experience. Would have he been lenient on Mr Johnson if he had done that to his daughter? I think not...he would have been asking for the death penalty. Judge Stine needed to wake up and do the right thing! Too bad he did not.
That is where the problem lies, the clients will have the benifit of the doubt as to what the attorney is really capable of.
