Orly Taitz Update--Pay the Money!


Justice Samuel Alito has ordered dentist and California attorney, Orly Taitz to pay the money.  Justice Alito denied Dr. Taitz's request for a "stay," the second U.S. Supreme Court smack down of the birther-litigator.  Perhaps, she'll go for the trifecta?  Who knows?

Dr. Taitz was sanctioned by Columbus, Georgia U.S. District Judge Clay Land after Taitz's motion on behalf of a client for a restraining order to prevent the deployment to Iraq of  Captain Connie Rhodes, a U.S. Army physician. Taitz claimed the order was illegal because President Obama was serving illegitimately as president based on the "birther" theory of President Obama's citizenship. Judge Land deemed the various Taitz motions as frivolous. In response, Dr. Taitz publicly labeled Judge Land's decision as “an act of treason.".

Judge Land denied Taitz's second motion and issued an order for Taitz to show cause why she should not be sanctioned. Captain Rhodes sent a letter to Judge Land asserting that Taitz filed the rehearing motion without client consent. Judge Land issued a $20,000 sanction for Taitz’s violation of Rule 11 of the Federal Rules of Civil Procedure.

“Counsel's pattern of conduct conclusively establishes that she did not mistakenly violate a provision of law. She knowingly violated Rule 11. Her response to the Court's show cause order is breathtaking in its arrogance and borders on delusional,” Land wrote in his sanctions order.

My guess is that Dr. Taitz, not only got too close to the flame, she is on fire.  We will see how much longer the California disciplinary authorities sit on the sideline.  Bear in mind that there are fraud and perjury charges out there, stemming from one of these birther lawsuits she ill-advisedly filed.

Orly Taitz Update


The ABAJournal.com brings us up to date on out favorite Birther-attorney and California dentist, Orly Taittz.  When Bad Lawyer last looked at the antics of Dr. Taitz, she was battling sanctions for frivolous conduct arising our of preposterous lawsuits filed, among other places, in Georgia where sanctions of $20,000 were imposed upon her.  At that time, the 11th Circuit Court of Appeals rejected her appeal and now she has filed the second of two "stay" requests with the US Supreme Court.  The first request was filed with Justice Clarence Thomas who summarily rejected the "stay," and the second is with Justice Samuel Alito where it remains pending.  What's amazing, according to two legal observers quoted in the ABAJournal post is that the "stay" procedure is a seriously incorrect process:

"Her effort is problematic on at least two fronts, legal observers say:

First, she should have filed a writ of certiorari with the high court, seeking to appeal the fine. 'Stays are for people condemned to death [who] are on the gurney,' says attorney Bill Mason of Columbus.

Second, another Columbus attorney, Frank Martin, questions Taitz's claim that it is appropriate to go to justice after justice with the same stay request, if it is denied. Taitz is, he says, trying the patience of the Supreme Court with this tactic."

Orly on Her Way Out?

Talking Points Memo is reporting that the California disciplinary authorities are looking at everyone's favorite "Birther" lawyer/dentist, Orly Taitz.  Apparently submitting pleadeings and motions supported by perjurious affidavits and forgeries is not ok, afterall.  Taitz was admitted to practice law in California in 2002.

Sanctions Upheld

This just in, the 11th Circuit Court of Appeals has upheld the $20,000 sanction imposed against Lawyer/Dentitst Orly Taitz has been upheld.  As you no doubt know if you read Bad Lawyer, Taitz is the lawyer behind the "birther" movement.  She's batting .000 in her multiple federal lawsuits, and the betting here is that she will be benched at some point if she insists on continuing to file these frivolous lawsuits.

Lucas Daniel Smith, a "birther" witness has provided a declaration saying dentist/attorny Orly Taitz suborned perjury as part of her federal lawsuit directed at invalidating the election of the President of the United States. If true, (always a dangerous assumption regarding anything having to do with Orly Taitz and the  birthers) , this invariably means that Dr. Taitz days as a licensed attorney are numbered.

Good bye, Orly.  It was fun.

Orly Taitz, Rule 11 Sanctions

Orly Taitz, dentist, lawyer, and Birther-movement queen was sanctioned (ordered to pay $20,000. to the US Government in 30 days) by a U.S. Dsitrict Court judge for her frivolous conduct in violation fo Federal Rule 11. Dr. Taitz, a Soviet immigrant, practicing dentist as well as a lawyer has been filing lawsuits attempting to establish that the President of the United States is not a "natural born US citizen" and therefore ineleigible to serve as President of the United States. Dr. Taitz has produced two patent forgeries purporting to be Kenyan birth certificates of the President of the United States.

There is nothing wrong in pursuing controversial casues and in taking daring positions. Even good lawyers risk sanctions from time to time to represent unpopular clients or causes--but shoddy legal work and offering evidence that doesn't meet the smells like merde-test! C'mon, Dr. Taitz isn't a Bad Lawyer, Dr. Taitz is a clown.
