The Incredibly Curious Case of Judge Alison Floyd


The incredibly strange Cleveland-area Juvenile Court Judge, Alison Floyd is back in the news at least locally in Cleveland.  You may remember the March posts about Judge Floyd, here, on Bad Lawyer and subsequently, nationally, as the stories about her unusual approach to serious crime victims shocked the legal community.   As we cruelly noted at the time, Judge Floyd is not the "sharpest knife in the drawer"  she does nothing to change that view with a recent set of rulings, a local Cleveland television station reports:

"19 Action News is asking the tough questions. We want to know why a Cuyahoga County [Cleveland, Ohio] judge just released an accused 16-year-old charged with sexually assaulting an eight year old. Judge Alison Floyd released the boy to his parents and when 19 Action News reporter Scott Taylor went to ask we why her reply, 'No Comment.'

Floyd's latest decision is just another in a string of questionable ones.  In the spring of 2006, two teens accused of starting a fire at a school got a big break from Floyd. They caused $300,000 worth of damage. One was sentenced to the custody of mom and the other walked because the prosecutions' main witness never showed. In another case, she ruled there was no evidence a teen with a loaded gun threatened to shoot a cop.

She said prosecutors failed to show probable cause. That teen later pleaded guilty in adult court to the charges and got 12 years in prison.  Another Floyd decision: two teens robbed and stabbed a man in downtown Cleveland.  Floyd gave the main attacker probation. The victim was understandably shocked  'I don't think people feel safe knowing that people who try to kill you with a knife is back out on the street with no consequences what so ever,'  victim Tony Viola said."

The WOIO, 19 Action News report concludes by sarcastically noting that Judge Floyd refuses to comment; not that any Judge would or should comment on a case that he or she is hearing; and, may have to issue further rulings in as with most cases involving juveniles.  Nonetheless, the television station is correct in wondering, wtf!!  Judge Floyd seems to have relinquished any concern for victims as was widely remarked onc last May, at law "blawgs" nationally, including the ABAJournal when she ordered juvenile rape victims to undergo polygraph testing.

What's curious about Judge Floyd is how is it that she remains on the bench?

  1. If you think this judge makes BAD decisions and BAD rulings in criminal cases you should see the BAD rulings she makes in child custody cases. She has got to be One of the worse judges in the County Courts right next to Angela Stokes in the Muny Courts !!!!!!

    3. Gives the child to abusive parents without caring what the parent does to the child and evidence to prove child abuse and Floyd throws out the evidence. Soneone needs to throw her out?

    5. 9 years later, Judge Floyd is still on the bench. Nothing has Changed. She is an absolute disgrace to Lawers and Judges everywhere.

      Just today October 3, 2019 I witnessed her throw a complete child like temper tantrum against a Prosecutor for no apparent reason. It was embarrassing. The prosecutor was asking standard questions that they ask every police officer on the stand when Judge Floyd lost it banging her hands on the bench and yelling.

      This is a small snippet of today's unprofessional acts. This is not the first time I have been in her court room, but everytime I walk away upset, confused, and disappointed in her behavior.

    6. To clarify I am a police officer, and the case is a sexual assault kidnapping. The evidence is overwhelming, and she has already dismissed this case once for no good reason.

      She does not want this young known gang member to go to jail. For God sake he had a friend video the rape. I am disgusted, and appalled by her lack of compassion for victim's of terrible crimes

    7. It is a travesty. She is as incompetent as they come, yet runs unopposed every election because no one wants the job. hell the person quit on the first day that ran the juvenile court. something has to be done with this incomptent twit. she has to be retirement age or enjoys making people miserable . I lost custody of my son and we are suburban parents never married so we had to go in front of this Honorable Judge for 2 years and 19k in attorney fees . court psychologist as well as child's counselor said no change in custody. GAL who bought in to other parents lies and living in a 400k house bought step mom (no kids) and dads lies and judge allowed child motion to "choose" parent AFTER a 2 year trial. well wouldnt you think that should go first if you are going to honor that anyway. Soooo after fighting and 19k in attorney fees Honorable judge granted childs wish. what a waste of money.
      At least I know , I fought and did the best for my childs best interest in my heart.

  2. It is unacceptable for this Judge to ruin children's and parents lives.
    She is not a Christian and needs to undo some of the damage she has inflicted on innocent lives...

"YOU DO NOT LET THE JUDGMENT OF OTHER PEOPLE DEFINE YOUR CIRCUMSTANCES, YOU TAKE DO THE DEFINING" Most people judge Judge Floyd for what her rulings are, I think that is unfare.She is doing a very hard job, but trying to give our youth a chance to make better choices. If they choose to throw that away then that is on them and their parents.Being a christian does not have anything to do with her JOB!

  5. I have been the custodial parent of my 16 1/2 year old son since 2000 after he was physically abused by his mother. In 2002 the case was moved to floyds courtroom after his mother got a new attorney which seemed funny. In 2004 we had a trial after Mother attempted to regain custody and Floyd appointed me a attorney because I could not afford my own attorney. In 2005 she ordered me to pay $27,000 to cover attorney fee's for the Mother's attorney and $7000 for the GAL even though I could not afford my own attorney. Think someone got a kickback ?? The FBI should investigate her, what a joke. Nothing is in the childs best interest !!

  6. This is why she is still on the bench: she is a DEMOCRAT. The Democrat party machine in Cuyahoga county will protect every Democrat no matter how criminal, until FBI busts them. FBI has been doing just that: sending Democrats to jail.

  7. Judge Floyd is a very hard-working woman. As THE ONLY BLACK FEMALE presiding on the bench in Juvenile Division, she is the most vulnerable and the least respected. This woman can only rule upon evidence presented. If prosecution fails to present solid evidence, so be it! Everyone is so quick to give an opinion when in fact, they have no idea how the system is structured or operates. Do your research before commenting.

  9. alison nelson floyd being black and a woman has nothing to do with her being one of the worst judges ever elected in cuyahoga county. bear in mind the fact that this county is basically democratic and its constutents love to vote blindly for %$&*(( who have no business determining the course of young childrens lives especially since it has been common knowledge that her own stepkids have no repect for her and have been putting her through the paces, which most stepparents end up being subjected to. think that she is awful during criminal cases too bad the public are not allowed to view her tactics when it comes to trying to wrangle children loose from unfit parent[s], especially if that parent happens to be the mother. THE CHILDREN END UP SUFFERING AND ETERNALLY ENDURING WHATEVER ABUSE OR NEGLECT THAT IS/AND CAN BE PROVEN WITH ALL THE PROPER DOCUMENTATION NECESSARY. THIS CRAZY WOMAN TURNS A DEAF EAR AND BLIND EYE TO EVERYTHING THAT COULD BOLSTER THE FINAL JUDGEMENT OF PERMANENT REMOVAL FROM THE ABHERRANT PARENT IN QUESTION!!! believe this one thing that is apparent in private child custody cases this schizoid, cold broad will wear you out by burning a hole in your pocket through running up attorney fees, assigning unneeded GALS, continuing to postpone what she knows is going to be her final opinion of siding with the unfit parent[s] thereby assuring that there will never be any justice obtained for the desparate juveniles caught in the middle of her mockery of the custodial aspect of the justice system. and for all of her supporters that appear to stand and back her for all the crazy crappy rulings that she emits, we all bet that you are on her judicially taxpayer funded payroll. and President Barack Obama has not a damn thing to do with all the horrible psychotic decisions this woman makes, you must get off that racial diatribe that you white folks are so prone to offer up. Being crazy is all it is about nothing else, unless she also happens to be still suffering the rages of hormonal pms, but that too shall pass as she is getting up in age. Before I part just consider about how slim her margin of beating out her fellow democratic counterpart, John Lwason...1649 votes. We could have done better and ridded ourserves of the scourge who has the nerve to jump on the internet revealing confidential privileged information and facts concerning some of the most mind-boggling and tragically ending situations.

    1. She is very unpredictable. She's putting us through the ringer now with our foster sons trail. Almost 3 years in care abusive parents and she's planning on sending them back. We thought we were going to be able to adopt, but she's sending them back. Started visits and the abuse has already started. Nobody seems to care

    2. I'm working on a case she wrongfully convicted. She railroaded this young man along with her special prosecutor Oscar Rodriquez who was fired for misconduct.

    3. i just recently was seen by this judge and she is still as bad as it gets. I have been the sole caretaker of my son for 10 years, his father shows back up and decides to be a parent finally and I lose custody of my son because I did not his father disrupting my son schedule by doing random pop ups and trying to enact visits he never used before and because I refuse to put my son back in a school system that was failing him by continuing to promote he with out teaching him the adequate material needed to move forward, a school system that was allowing my son to get bullied everyday that he was there and doing nothing to intervene and noting my son as a trouble maker when he fought back against his bullies. She is a horrible excuse for an officer of the court. In fact the whole justice system is set up to make those that are doing right fall the hardest.

    4. Same happened to me. She is a DISGRACE!!! Get to the POLLS and vote and get her off the bench. she has ruined more families Just reading these comments cements what happened to me. She couldnt see the truth if it hit her in the head. The lies told about me were so vile and over the top and hear say and even disproved and still this homewrecker put the child in the hands of an abuser. It is shocking. If anything happens to my child in the care of the other parent, the county will be held responsible solely because of her and an inept GAL that was a laughing stock. Good Job Cuyahoga County!!

  12. I'm a cop and had a case in front of Floyd regarding a young black male offender in a near west side Cleveland suburb. After investigating the complaint and receiving a good suspect, I questioned the young man, who was 16 years-old at that time, and subsequently received an admission. He was charged accordingly and the case eventually went to trial in Floyd's courtroom. She would later rule that the male was not delinquent and inferred that I was lying about giving him Miranda prior to my interview with him. Lets fast forward one year (almost to the date) and this same kid just broke into the SAME apartment. Although this case has not yet reached the court, I'm hoping that it doesn't get assigned to her, however, I have a feeling that it wouldn't matter anyway. This "Judge" is a disgrace and bias against police!

    1. I definitely thinks she is biased against the police or prosecutors office. My daughter had a case and she wouldn't let the prosecutors office get a word out. She ended up finding him non delinquent aand never notified the prosecutors office nor myself. She is a pure disgrace aand i have no clue why she is still in office. I will make it my personal mission to not have this lady re elected.

  13. Judge Floyd refuses to hear cases concerning custody when she has made an error in judgment. She tries to cover her mistakes by punishing parents and children. She needs to be removed from the bench.

  15. She's honestly terrible!!!!I've dealt with her! Her decisions are crazy! My husband BRUTALLY beat me, dcfs took my children so I could get counseling,because they insisted I NEEDED it, kept my children away from me for 5 months only for her to dismiss my case completely and my children were put back into my custody ALONG WITH MY ABUSIVE HUSBAND having custody as well. Ridiculous! He's violent!!! My 6 year old watched their father almost kill me!!!! Wtf!!! And now she's in the news for this crap!!!!! UNBELIEVABLE!!! THIS WOMAN SHOULD NOT BE A JUDGE! SHE NEEDS TO BE IN A CRAZY HOUSE! who keeps children from their perfectly fit parent!!!! And given back not only to me but also a very violent man! Shame on Cuyahoga county dcfs. And juvenile court system for turning their head to bullshit like this!
